HIgher Speeds equals bigger accidents

For nearly 40 years our offices have known that higher speeds equals bigger accidents.  You are probably saying to yourself “No kidding Nick, that is just basic physics”.  

When you add in a crazy polar weather pattern, you have a deadly Texas sized pileup on the freeway. Literally.  130 vehicles where damaged or destroyed and six people lost their lives in Texas during just such an event in February 2021.  Why? Simply because too many people were traveling when they didn’t need too, and they were going too fast for the conditions.  While the cause might be that easy, the responsibility isn’t.  It will take years for experts to figure this one out.

There is a formula that engineers use to describe the amount of energy a moving vehicle has.  It is E=MV2.  E is the total energy the moving vehicle has, M is the Mass and V is the velocity or speed.  That little two means that the “V” or velocity is squared.

The Power Of Square

It really is an amazing thing to think about, that the V is squared.  This means that if you are in a 1 ton car going 10 miles per hour your energy is 1 ton times 10 miles per hour squared.  Your energy factor is 100.  But if you double the speed you don’t just double the energy.  At 20 miles per hour your energy factor or “E” is equal to 400.  Doubling the speed increases your energy by four times!

Mass has a lot to do with the equation too.  A compact car can weigh as little as 2300 lbs.  At 65 miles per hour it can do a lot of damage.  A big rig can weigh as much as 80,000 lbs.  Nearly 40 times more than a small compact car. 

The V Isn’t Only Cars And Trucks

The cool new thing is electric bikes.  Many electric bikes are limited to 20 Mph and “fast electrics” now hitting 30 Mph or more.  Many shared paths limit bikes to 5 mph in California and yet we see them whizzing by at top speed all around our homes here in the bay area and around California.

A pedestrian getting hit by a regular road bike at 10-15 mph can be a serious accident with some pretty bad injuries.  Just like cars and trucks, doubling the speed of a  bike from 10-20 miles per hour gives the electric bike 4 times the energy.   Add in the extra 40 to 70 pounds for the extra weight on the electric bike and suddenly the electric bike has the potential to do damage like a car.

A “fast electric” at 30 Mph is 9 times more powerful than a bike at 10 miles per hour.  Think about being hit with a 900 lb hammer.  That is what a fast electric bike can become.

Electric bikes can cause serious personal injury or even death.

Riding Safe

Once upon a time, California made all grade school kids learn to walk against traffic and ride with traffic.  Today we see people of all ages riding illegally on sidewalks and opposite traffic.  When you ride opposite traffic, you add your V to the other persons V and then square it.  Two electric bikes hitting head on have 16 times more energy than a regular bike by itself.  

The energy of two electric bikes can nearly equal that of a small car. Going head on with a car can increase the energy at impact to the point that survival is almost impossible.  When you ride with traffic, your V is removed from the cars V before being squared.  This little bit of math might just save your life.

Riding in the bike lanes, passing to the left, slowing down in shared paths and using a bell to alert pedestrians are all ways that you can ride safer.  Being courteous to everyone is part being civilized and of living in a healthy society.  It also helps to keep you from being negligent when it comes to an accident.

Rear End Accident Settles for $4.25 Million!

Ed and Nick Mastrangelo have seen a lot of accidents in the East Bay.  For nearly 40 years the Mastrangelo brothers have been serving the needs of injured Californians. Nick Mastrangelo and I obviously talk about accidents a lot.

Nick and I were discussing how speeds have increased and drive times have dropped.  Clearly the “Shelter at Home” order from Governor Newsom has changed the traffic pattern. With the higher speeds come bigger accidents though.  Rear end accidents are the most preventable and yet they happen daily in the Bay area and East Bay.  

When you think of a rear end accident you normally think about stopped traffic.  The foggy freeways of central California are another place we see multi car pileups.  These big pileups usually start with one rear end accident, and the big ones are on the news. 

Nick shared with me an accident that was a little different. He was telling me about a client that was injured in a rear end accident. That accident was worth a $4.25 Million settlement.  When he told me the number, I was shocked.  I mean, I just couldn’t wrap my head around that number. Mostly because I had been at both ends of these accidents when I was younger.  The first time, I was rear ended by an uninsured motorist in my 1984 VW Golf.  From the looks of it you would think the car was totaled.  Since I was in college and broke, I did not talk to a doctor about my ensuing neck pain.  My insurance paid $2500 to fix my car. It was worth $3000 back then.

The next accident involved a woman was making a right turn to merge into high speed traffic.  When I looked up, there were no cars coming.  When she started to move. I let off the brake and reached down for my cell phone. The next thing I knew, BAM!  She was stopped and the back end of her BMW was pretty well done in by my big truck.  Thankfully the damages were under $5,000 and she wasn’t injured.  It turned out though she was a “pro” at getting rear ended and this was the 15th time that car had been hit.  Her boyfriend worked at a body shop and split the money with her.  My insurance company gave me my deductible back two years later when the case settled.

More recently I watched a teenager texting on the highway with traffic at a dead stop just in front of them.  Two cars were destroyed in that one, and thankfully no one was seriously injured.  I share all of this with you because of the value of the settlement that Mr. Mastrangelo shared with me. I just couldn’t get from my two little accidents to add up to $4.25 Million.

The first question I asked was if the plaintiff (the guy in the front of the accident) was injured.  

Nick told me that the 49 year old carpenter’s pickup was hit so hard from the back that it threw the truck off the state highway.  After being tossed from the highway,  the truck rolled several times down the hill.  Worse yet,  the driver was ejected after his seatbelt let go.  The truck finally stopped in a ditch on the side of the road, on top of the driver.  Yes this case was a little different.

The carpenter (driving the truck that was hit) suffered multiple injuries which kept him from returning to work for some time.  Nick shared with me that “Our client was ejected during the collision and his truck came to rest on top of him.  He sustained a crushed pelvis, multiple rib fractures, a collapsed lung, a ruptured bladder, a fractured collarbone, and a torn urethra.  He underwent multiple surgeries and was hospitalized for 13 days.  He made a gradual recovery but was unable to return to his physically demanding job as a carpenter.”

The other driver, aka the defendant, that hit the carpenter, admitted some fault and liability. The defendant also claimed that at the time of the accident, the carpenter was thrown because he was not wearing his seatbelt.  The carpenter testified that he was wearing a seat belt and it failed after his pickup rolled over several times.

Clearly not all accidents are the same.

Covid-19 highway safety

Covid-19 is changing Highway Safety.

For over 35 years the Mastrangelo Law offices has seen improvements to highway safety. We’ve been around long enough to remember a time before seat belts, air bags, guard rails, automatic brakes and a host of other safety devices. All of these safety devices are the reason highways have become safer.

Some might argue that lawyers aren’t necessary. The reality is that without lawyers, many of these safety devices would not exist. Lawyers are here to protect you when the government or insurance companies don’t. Just because the highways are safer doesn’t mean you can’t be injured in an accident.

The recent shelter in place order due to Covid-19 has resulted in a drastic drop in traffic. A recent article in BeachStreetNews reported on another change to what is happening on the roads. They reported that reduced traffic is leading to fewer distracted driving accidents. BeachStreetNews also said it is leading to another type of accident we don’t normally see. High speed, high impact accidents.

Police are reporting speeds occasionally hitting triple digits in the golden state and cleaning up the resulting accidents isn’t easy. The formula for energy is E=MV2. The V2 is the important part. Just 10 miles an hour faster adds 100 times the weight of the car to the energy at impact. Air bags can only stop so much. Highway safety is changing due to the covid-19 shelter in place, and not in a good way.

The higher speeds are resulting in much more devastating accidents. Here in Northern California we have some great roads and we get the temptation to test them. For your safety and ours, please don’t.

Billboards that will make you laugh from lawyers that are sometimes referred to as “necessary Evil” and all kinds of caricatures exist in the society to depict the good and bad side of law.

So even though accident law is serious business at Mastrangelo Law offices (MLO Lawyer), we decided to see the lighter side of being an accident lawyer by scraping few funny Accident lawyer billboards from the Internet.

I came across a few funny accident lawyer comics on the Internet, so I will post a mix of them here:

  1. Got into a car crash and injured? This one is just plain blunt and hilarious. Keeps it really simple, and doesn’t even put a phone number on it. Talk about brand building at best !

I guess anything becomes funny when you add a Gorilla into the mix 🙂 If you ask me, the billboard has too much information on it, and people driving at 65mph can barely read two sentences. And seriously though, what does “get the Gorilla” even mean? I think it’s trying to appeal to young blokes who got into an accident (and they have just learned how to drive!)


This one is a classic, clean cut, like bald? lol. Besides the fact that people don’t become bald by pulling hair, this one is also funny because the lawyer on the billboard is bald! Very simple, clean fun and call to action with a phone number. This one is one of the best personal injury lawyer billboards ever!


Another great billboard that can lead to great brand building. People looking at this can instantly relate to this, not because we crash into posters or walls all the time, but because we see such images in movies and TV all the time and we can relate to this.

It also comes with a tag line which says “Don’t settle for less”, which is very emotional and it connects with the people on a different level.

Is Driving Tired Driving Drunk?

Driving Tired is a major cause of accidents according to the CDC. Several studies equate being tired to being under the influence of drugs or alcohol. When someone drives tired only one drink may be enough to make them a risk.

If you are involved in an accident after a long day of work, it may be that you or the other driver were driving drowsy. It isn’t any safer than driving drunk.

How Do Pilots Avoid Flying Tired?

Airline pilots get training in fatigue mitigation. Basically they are taught to recognize that they or the other pilot are responding slower and are fatigued. Part of the training includes strategic use of caffeine.

American’s are already over stressed and don’t get enough sleep, so learning how to use caffeine can be a lifesaver. You can’t just drive through for a coffee on the way home.

Caffeine Use Tips:

Keep in mind that none of this works if you are using caffeine all day just to function. Basically if you need caffeine all day, you are already fatigued and probably shouldn’t drive without a nap, an energy boost or both.

Tip One. – It takes 30 minutes to an hour for caffeine to work. This means you should have that cup of coffee or tea at least 30 minutes before you jump in the car to insure maximum alertness. The best trick is to take a 30 minute nap right after the coffee so you get the benefits of both the coffee and the nap.

Tip Two. – Since caffeine can affect sleep for up to five hours after consuming it, the rules are much the same as alcohol. No caffeine within four hours of bedtime. A good rule for nine to fivers’s is that caffeine should stop at about 4 pm to make sure you get the best sleep each night.

Tip Three. Get proper rest. Most people need six to eight hours of sleep each night and our bio rythms are designed to take a short walk and a short nap after a mid day meal.

What To Do After You’ve Been In An Automobile Accident?
