HIgher Speeds equals bigger accidents

For nearly 40 years our offices have known that higher speeds equals bigger accidents.  You are probably saying to yourself “No kidding Nick, that is just basic physics”.

When you add in a crazy polar weather pattern, you have a deadly Texas sized pileup on the freeway. Literally.  130 vehicles where damaged or destroyed and six people lost their lives in Texas during just such an event in February 2021.  Why? Simply because too many people were traveling when they didn’t need too, and they were going too fast for the conditions.  While the cause might be that easy, the responsibility isn’t.  It will take years for experts to figure this one out.

There is a formula that engineers use to describe the amount of energy a moving vehicle has.  It is E=MV2.  E is the total energy the moving vehicle has, M is the Mass and V is the velocity or speed.  That little two means that the “V” or velocity is squared.

The Power Of Square

It really is an amazing thing to think about, that the V is squared.  This means that if you are in a 1 ton car going 10 miles per hour your energy is 1 ton times 10 miles per hour squared.  Your energy factor is 100.  But if you double the speed you don’t just double the energy.  At 20 miles per hour your energy factor or “E” is equal to 400.  Doubling the speed increases your energy by four times!

Mass has a lot to do with the equation too.  A compact car can weigh as little as 2300 lbs.  At 65 miles per hour it can do a lot of damage.  A big rig can weigh as much as 80,000 lbs.  Nearly 40 times more than a small compact car.

The V Isn’t Only Cars And Trucks

The cool new thing is electric bikes.  Many electric bikes are limited to 20 Mph and “fast electrics” now hitting 30 Mph or more.  Many shared paths limit bikes to 5 mph in California and yet we see them whizzing by at top speed all around our homes here in the bay area and around California.

A pedestrian getting hit by a regular road bike at 10-15 mph can be a serious accident with some pretty bad injuries.  Just like cars and trucks, doubling the speed of a  bike from 10-20 miles per hour gives the electric bike 4 times the energy.   Add in the extra 40 to 70 pounds for the extra weight on the electric bike and suddenly the electric bike has the potential to do damage like a car.

A “fast electric” at 30 Mph is 9 times more powerful than a bike at 10 miles per hour.  Think about being hit with a 900 lb hammer.  That is what a fast electric bike can become.

Electric bikes can cause serious personal injury or even death.

Riding Safe

Once upon a time, California made all grade school kids learn to walk against traffic and ride with traffic.  Today we see people of all ages riding illegally on sidewalks and opposite traffic.  When you ride opposite traffic, you add your V to the other persons V and then square it.  Two electric bikes hitting head on have 16 times more energy than a regular bike by itself.

The energy of two electric bikes can nearly equal that of a small car. Going head on with a car can increase the energy at impact to the point that survival is almost impossible.  When you ride with traffic, your V is removed from the cars V before being squared.  This little bit of math might just save your life.

Riding in the bike lanes, passing to the left, slowing down in shared paths and using a bell to alert pedestrians are all ways that you can ride safer.  Being courteous to everyone is part being civilized and of living in a healthy society.  It also helps to keep you from being negligent when it comes to an accident.

Sadly this doesn’t always happen.  If you are in an accident, call us.  Bikes, cars and trucks, we handle them all because the physics is always the same.

What Happens to Your Family After a Commercial Truck Accident?

No one thinks they will be in a commercial truck accident.

As parents, spouses and partners, we worry about other people.  Something you might ask is “What would become of our families in a worst-case scenario. What If I died in a truck accident?  Would my spouse or partner have the financial resources they would need to pay for necessities? Would my children have the money to afford a college education? A funeral? A wedding?” These worries keep us up at night. After all, you never know when tragedy can strike

The fortunate among us have the wherewithal to purchase life insurance. Sometimes it isn’t enough. Life Insurance benefits might not cover every expense our families may need in a future that does not have us in it. Or what about the scenario where you are injured to the point you can no longer work and provide for your family?  You become an expense and the life insurance does nothing.  We never like to think about those things but they happen.  For over 30 years I’ve been helping people in both of these situations.

Big Rig Truck Accidents: Unexpected, Deadly, and Expensive

Thousands of people die, and hundreds of thousands more suffer injuries, every year in California traffic accidents. Because of the large sized and heavy weights, commercial truck accidents can be the most damaging.  Truck crashes have some of the most deadly and devastating outcomes. In a collision between a large truck and a passenger vehicle, the smaller vehicle and its occupants are usually the ones to sustain the worst of the damage. The disparity in size and weight between a big rig and a sedan, for example, is so large that a crash can flatten, mangle, or tear the car in two.  The impact on motorcycles and bicycles is even worse.

Drivers and passengers in a regular car or SUV are lucky to escape with their lives. The sad truth of truck cases is that many do not. Those who do survive often face catastrophic, life-altering injuries. These injuries might even inflict permanent disabilities. The injury toll of a large truck crash frequently includes:

  • Spinal cord injuries. The sudden power of impact by a truck or big rig can twist or damage the spine to the point the spinal cord is crushed or pinched.  Injuries like this can leave victims permanently paralyzed and facing the massive challenge of adapting to an altered existence.
  • Traumatic brain injuries.  The harsh impact of a truck accident can injure the brain in ways that cause permanent cognitive, motor, and emotional impairments, or worse, plunge victims into a coma or state of semi-consciousness from which they might never emerge.
  • Crushed and traumatically amputated limbs that require multiple surgeries and prosthetics to treat, and still leave a victim facing a lifetime of chronic pain.
  • Neck and back injuries that never truly heal, and instead leave a person in a state of permanent, debilitating discomfort.
  • Burns that cause agonizing pain, disfiguring scars, and lasting emotional trauma.

There can be other damage and injuries after being in an accident with a truck or big rig. The East Bay is a major trucking area with shipping ports, refineries and factories all located here.

Truck accidents victims and their families suffer not just physical and emotional pain from these injuries and deaths, but also untold expense. Medical bills to treat catastrophic injuries from a truck accident can run into the hundreds of thousands of dollars. These bills occur whether or not the accident victim survives the trauma of the crash. Accident victims who survive miss months of work at a minimum. Some never return to a job in their former capacity, or at all, robbing their families of important income.

Every aspect of life becomes more difficult and expensive after an accident. Victims and grieving families need help with day-to-day tasks the injured truck accident victim used to handle, like childcare, transportation, keeping a home, and managing finances. Bankruptcy and financial ruin constitute a very real, and very sad, toll of a truck accident for many families who don’t have the money, insurance or know where to turn for help.

After a Truck Accident Get Help

As difficult as it is to focus on moving forward after a truck accident, it is important to do so.  There are resources out there for you, even if the truck is from out of state or even another country.  The assumption that the trucking companies insurance will just pay for everything is normally wrong.  Sometimes there is damage beyond what you initially think about after the accident.  The problems usually go much deeper.

If you were to sustain catastrophic or fatal injuries in a large truck crash in California, your family might have the option of obtaining compensation from a variety of sources:

  • Auto insurance. California requires all trucks in the state to carry insurance.  You should also have insurance on your car.
  • Health insurance. Health insurance is also mandatory in California.  If you have health insurance, it will likely cover some of the expenses for your medical care after a truck accident, subject to any co-payments, deductibles, and coverage limits. So, with any luck, your family will have some protection against bearing the full brunt of the massive healthcare-related costs of treating your injuries in a truck crash.
  • Workers’ compensation insurance. If you suffer devastating or fatal injuries in a California truck crash while working, then chances are you and/or your family will have the right to receive workers compensation. Workers’ comp in California may cover the costs of medical care and lost wages due to a disability because of a work-related injury, regardless of fault.
  • Supplemental (long-term disability) insurance. Some people carry or receive as a work benefit, a form of private insurance that covers additional costs of missing work because of a long-term disability. This is the type of insurance advertised on TV by AFLAC and its talking duck mascot.
  • Life insurance. Some people also carry private life insurance or receive life insurance coverage as a work benefit. This coverage typically pays a lump-sum benefit if the insured dies in a California truck accident.

This list is just part of the resources we look at when we are trying to help the victim of an accident or their family.

Financial support from Insurance represents only one of the potential avenues for assistance.  While your family might have good insurance for financial support after a tragic truck crash leaves, it may not be enough if you or a family member are catastrophically or fatally injured. You and your family may also have the right to pursue legal remedies against anyone whose poor decisions or careless actions caused the truck crash that did you harm.

Here is how.

Beyond Basic Insurance Coverage

Many California drivers have the mistaken impression that the state’s insurance laws mean that they will be taken care of by the insurance and the insurance will pay.  If you or someone in your family sustain truly serious injuries in a truck crash, you have the right to take legal action against the individuals and entities who caused your accident and injuries—injuries like the ones listed above that leave you permanently disabled, disfigured, or dead.

Who Has Liability?

Who might have liability to you and your family for causing your catastrophic or fatal truck accident injuries? More people than you think might be responsible for a commercial truck accident. Our 30 plus years of experience as truck accident injury lawyers have taught us to explore whether any of the following “usual suspects” may have liability for a crash, for example:

  • Truck drivers, if their careless or reckless actions behind the wheel caused the collision that left you badly injured.
  • Trucking companies that employ truck drivers or operate the truck involved in the crash, especially if their actions ignored warning signals that the driver or the equipment were not fit for the road.
  • Shippers who load cargo into large trucks without taking care to secure it, running the risk that the cargo could shift in transit and cause the truck driver to lose control.
  • Mechanics who fail to maintain trucks in proper working order.
  • Manufacturers of trucks and truck parts, if they sell defective products that lead to mechanical failure and a crash.
  • Medical professionals who prescribe prescription medications to truck drivers without warning about potentially dangerous side effects that could cause the trucker to lose focus or control behind the wheel.
  • Government agencies tasked with designing, building, and maintaining safe roads for truckers and the general public to use, if they fail in their mission and cause an accident.

These are examples, only. Every truck accident has its own unique facts and circumstances. The facts and circumstances dictate who might have legal liability in a commercial truck accident. The most reliable way to figure out who might have legal liability to you and your family after a truck crash is to work with an experienced truck accident injury lawyer.

How Much Money Can You Get in a Truck Accident Case?

It is true that no two truck crash cases are exactly alike, so it is impossible to say for certain how much money you or your family might expect to recover. Our firm has recovered over $250,000,000 for its clients.  Recently we has an accident case where we recovered over $4 Million.  Typically the victims of a catastrophic truck accident caused by someone else’s careless, reckless, or intentionally harmful actions have the legal right to pursue compensation for:

  • Medical bills and other expenses related to treatment of truck accident injuries, whether or not the victim survives them.
  • Lost past and future wages the accident victim cannot earn because of truck accident injuries or death.
  • Physical pain and emotional suffering inflicted by the injury or death.
  • Loss of companionship, emotional support, and other relationships because of the injuries or death.
  • Property damage.
  • Funeral and burial expenses.
  • In rare cases, punitive damages to punish the parties who caused your injuries or death.

As you can imagine, from case to case the amount of money required to compensate for each of these categories can vary widely. No one can guarantee in advance that all (or any) of these categories will apply in any particular truck accident. However, these represent the most typical categories of money damages available for truck accident victims and their families, and in some cases they can amount to very large sums.

The most important thing for you and your family to understand about taking legal action after a truck accident is that it takes an experienced truck accident injury attorney. Experienced attorneys help give you the best chance possible of recovering maximum compensation. Lawyers who represent clients in truck accident cases know the critical importance of getting to work right away, and of investigating the facts in detail to identify all individuals and entities who may have legal liability to the victim and the victim’s family.

Why Is Getting a Lawyer Important after a commercial truck accident?

Because as a practical matter, the amount of money your family might receive if you get badly hurt in a truck accident can depend, in part, on how many parties have liability for your injuries, and what financial resources those parties have available to pay damages with. The more individuals and companies an attorney can find who might owe you and your family monetary damages, the better the chance of getting paid.  This is because the more insurance policies and assets they can find and connect to the accident, the more they are potentially available to tap.

You may not realize all of the financial, and medical burdens that you have until later if you don’t get experienced help right away.  Believe it or not, this is part of what attorney’s do.

Rear End Accident Settles for $4.25 Million!

Ed and Nick Mastrangelo have seen a lot of accidents in the East Bay.  For nearly 40 years the Mastrangelo brothers have been serving the needs of injured Californians. Nick Mastrangelo and I obviously talk about accidents a lot.

Nick and I were discussing how speeds have increased and drive times have dropped.  Clearly the “Shelter at Home” order from Governor Newsom has changed the traffic pattern. With the higher speeds come bigger accidents though.  Rear end accidents are the most preventable and yet they happen daily in the Bay area and East Bay.

When you think of a rear end accident you normally think about stopped traffic.  The foggy freeways of central California are another place we see multi car pileups.  These big pileups usually start with one rear end accident, and the big ones are on the news.

Nick shared with me an accident that was a little different. He was telling me about a client that was injured in a rear end accident. That accident was worth a $4.25 Million settlement.  When he told me the number, I was shocked.  I mean, I just couldn’t wrap my head around that number. Mostly because I had been at both ends of these accidents when I was younger.  The first time, I was rear ended by an uninsured motorist in my 1984 VW Golf.  From the looks of it you would think the car was totaled.  Since I was in college and broke, I did not talk to a doctor about my ensuing neck pain.  My insurance paid $2500 to fix my car. It was worth $3000 back then.

The next accident involved a woman was making a right turn to merge into high speed traffic.  When I looked up, there were no cars coming.  When she started to move. I let off the brake and reached down for my cell phone. The next thing I knew, BAM!  She was stopped and the back end of her BMW was pretty well done in by my big truck.  Thankfully the damages were under $5,000 and she wasn’t injured.  It turned out though she was a “pro” at getting rear ended and this was the 15th time that car had been hit.  Her boyfriend worked at a body shop and split the money with her.  My insurance company gave me my deductible back two years later when the case settled.

More recently I watched a teenager texting on the highway with traffic at a dead stop just in front of them.  Two cars were destroyed in that one, and thankfully no one was seriously injured.  I share all of this with you because of the value of the settlement that Mr. Mastrangelo shared with me. I just couldn’t get from my two little accidents to add up to $4.25 Million.

The first question I asked was if the plaintiff (the guy in the front of the accident) was injured.

Nick told me that the 49 year old carpenter’s pickup was hit so hard from the back that it threw the truck off the state highway.  After being tossed from the highway,  the truck rolled several times down the hill.  Worse yet,  the driver was ejected after his seatbelt let go.  The truck finally stopped in a ditch on the side of the road, on top of the driver.  Yes this case was a little different.

The carpenter (driving the truck that was hit) suffered multiple injuries which kept him from returning to work for some time.  Nick shared with me that “Our client was ejected during the collision and his truck came to rest on top of him.  He sustained a crushed pelvis, multiple rib fractures, a collapsed lung, a ruptured bladder, a fractured collarbone, and a torn urethra.  He underwent multiple surgeries and was hospitalized for 13 days.  He made a gradual recovery but was unable to return to his physically demanding job as a carpenter.”

The other driver, aka the defendant, that hit the carpenter, admitted some fault and liability. The defendant also claimed that at the time of the accident, the carpenter was thrown because he was not wearing his seatbelt.  The carpenter testified that he was wearing a seat belt and it failed after his pickup rolled over several times.

Clearly not all accidents are the same.

What Makes An Injury attorney different?

A Video Interview with Nick Mastrangelo about what makes an injury attorney different.

In this video, Nick talks about why he would’t be good as your divorce attorney and why you should not hire your divorce attorney after you have been injured in an accident.

Named one of the top attorneys in California, Nick Mastrangelo talks to Scott Bourquin about how he would hire an attorney. This is of course if his firm wasn’t available. Personal injury law firms are highly specialized. They need years of experience dealing with experts, accident law and insurance companies.

If you have been injured in an accident and aren’t sure if you need an attorney, or how to hire one, watch this video or call Nick. Find out what makes an injury attorney different.

Covid-19 highway safety

Covid-19 is changing Highway Safety.

For over 35 years the Mastrangelo Law offices has seen improvements to highway safety. We’ve been around long enough to remember a time before seat belts, air bags, guard rails, automatic brakes and a host of other safety devices. All of these safety devices are the reason highways have become safer.

Some might argue that lawyers aren’t necessary. The reality is that without lawyers, many of these safety devices would not exist. Lawyers are here to protect you when the government or insurance companies don’t. Just because the highways are safer doesn’t mean you can’t be injured in an accident.

The recent shelter in place order due to Covid-19 has resulted in a drastic drop in traffic. A recent article in BeachStreetNews reported on another change to what is happening on the roads. They reported that reduced traffic is leading to fewer distracted driving accidents. BeachStreetNews also said it is leading to another type of accident we don’t normally see. High speed, high impact accidents.

Police are reporting speeds occasionally hitting triple digits in the golden state and cleaning up the resulting accidents isn’t easy. The formula for energy is E=MV2. The V2 is the important part. Just 10 miles an hour faster adds 100 times the weight of the car to the energy at impact. Air bags can only stop so much. Highway safety is changing due to the covid-19 shelter in place, and not in a good way.

The higher speeds are resulting in much more devastating accidents. Here in Northern California we have some great roads and we get the temptation to test them. For your safety and ours, please don’t.

Don’t be a Covidiot – Be Safe

At the Mastrangelo Law Offices, all of us, want you to be safe on the highway. High speed driving should be saved for the track or video games where you limit the risk to innocent people. Because we know you can’t always count on the other guy, we are here for you if you are injured in a car accident.

For now, drive safe, be safe,

Personal Injury Lawyer Billboards that will make you laugh! Part 1

Billboards that will make you laugh from lawyers that are sometimes referred to as “necessary Evil” and all kinds of caricatures exist in the society to depict the good and bad side of law.

So even though accident law is serious business at Mastrangelo Law offices (MLO Lawyer), we decided to see the lighter side of being an accident lawyer by scraping few funny Accident lawyer billboards from the Internet.

I came across a few funny accident lawyer comics on the Internet, so I will post a mix of them here:

  1. Got into a car crash and injured? This one is just plain blunt and hilarious. Keeps it really simple, and doesn’t even put a phone number on it. Talk about brand building at best !
This is one is too blunt and funny

2. I don’t think you can talk about law and not mention Saul Goodman from breaking bad? Just super hilarious, Better Call Saul! I love the simplicity of the billboard, the logo and everything else around it.

.

3.

Get the gorilla!

I guess anything becomes funny when you add a Gorilla into the mix 🙂 If you ask me, the billboard has too much information on it, and people driving at 65mph can barely read two sentences. And seriously though, what does “get the Gorilla” even mean? I think it’s trying to appeal to young blokes who got into an accident (and they have just learned how to drive!)

4.

This one is a classic, clean cut, like bald? lol. Besides the fact that people don’t become bald by pulling hair, this one is also funny because the lawyer on the billboard is bald! Very simple, clean fun and call to action with a phone number. This one is one of the best personal injury lawyer billboards ever!

5.

Another great billboard that can lead to great brand building. People looking at this can instantly relate to this, not because we crash into posters or walls all the time, but because we see such images in movies and TV all the time and we can relate to this.

It also comes with a tag line which says “Don’t settle for less”, which is very emotional and it connects with the people on a different level.

If you are looking for a personal Injury lawyer in East Bay San Francisco area, then you can call the MLO Lawyer – Mastrangelo Law Offices in Orinda, CA.

Personal Injury Lawyer Settlement

How long does it take to Settle a Personal Injury Case?

It really depends! Some cases result in more physical injury and others cause more of psychological stress. So both are seen separately and the settlement can take longer depending on how much injury you have suffered. If you suffered loss of wages, and if the personal injury stopped you from working, then the losses are compounding and settlement can take more time!

According to Mastrangelo Lawyers in Orindo California, MLO Lawyer, U.S. tort laws give you the right to file claims for full compensation and register a case against the wrongdoer.” And for this you might seek help of a lawyer near you.

For this, you may need to take help of a personal injury lawyer. The lawyer will help you to get the rights compensation that you deserve for your injury. The best personal injury attorney will help you in filing a personal injury lawsuit. Sometimes, the cases can be settled by just negotiating with the party at fault. If the case is a serious one, then that goes to trial. Most likely, in a lawsuit, the person who suffers from the personal injury seeks a fair compensation for the injuries that he/she has already suffered as well as injuries that might follow (psychological).

What are some of the things that can be considered DAMAGES as a result of the Personal Injury?

  • Wage Losses
  • Emotional Suffering
  • PTSD (in cases of dog bites and other accidents)
  • Depression
  • Repairing or replacing lost property
  • Covering extra costs associated with the injury
  • Damages for future earnings

The actual duration of the case can vary with the cases. It is not possible to give the right answer about how long the lawsuit will take to settle. There are some cases which take at least a year from the date of filing the complaint to get to settle, and others can take around six months. So, it is quite unpredictable. A personal injury lawsuit can take 2 to 3 years to get settled in our experience.

Questions to ask your Personal Injury Lawyer?

Last week, we talked about what are some of the important qualities that your personal injury lawyer should possess. Now do you know what questions you should ask before hiring your lawyer?

If you Google “Questions to ask your Personal Injury Lawyer” you will get all kinds of answers, but to save you people some time, our law office has put together some questions that new clients ask us all the time:

  1. How much do you cost? Most PI Lawyers work on a reward basis, i.e. they get paid when you get paid for your damages. That can be typically 25% to 45%, but really depends on your lawyer and the situation.
  2. Will I need to pay if I lose the case? Again, it really depends on your lawyer. There are lawyers who don’t charge you anything if you lose the case, and there are some who charge you for their basic time in addition to the percentage of the reward.
  3. Have you had clients similar to me? This one is obvious, wouldn’t you want a lawyer who knows your situation to the “T”. In such a case, your lawyer knows exactly how to present your case, because they have previous data to work with.
  4. What are the chances of my success? Some lawyers even advertise the percentage of cases they have won, which is what makes some of them very expensive, as they are almost guaranteed to win your case (for e.g. MLO Lawyers :). But you should always expect the worst and prepare for anything that can happen in your case. If you call for a free consultation we will have a much better idea of your chances of success.
  5. Are you personally going to handle my case? There are many law offices where the real lawyer doesn’t even handle the case, instead, their interns and assistants handle the entire case. There is nothing wrong in asking them who will handle most of the case. At the Mastrangelo Law Offices, you will get to know your lawyer and the staff members that make up your team.
  6. What is your experience? Many law firms come and go from the accident world. Lured by big cases in the news these lawyers appear and disappear as fast as you can click an ad on social media. With over 35 years of experience and $250,000,000 collected for our clients, the Mastrangelo Law Offices is among the best and most experienced in California.

Have a questions to ask a lawyer about your case?

MLO offices serve the entire EAST BAY San Francisco, with personal injury clients winning cases more than 90% of the times!

Is Driving Tired Driving Drunk?

Driving Tired is a major cause of accidents according to the CDC. Several studies equate being tired to being under the influence of drugs or alcohol. When someone drives tired only one drink may be enough to make them a risk.

If you are involved in an accident after a long day of work, it may be that you or the other driver were driving drowsy. It isn’t any safer than driving drunk.

How Do Pilots Avoid Flying Tired?

Airline pilots get training in fatigue mitigation. Basically they are taught to recognize that they or the other pilot are responding slower and are fatigued. Part of the training includes strategic use of caffeine.

American’s are already over stressed and don’t get enough sleep, so learning how to use caffeine can be a lifesaver. You can’t just drive through for a coffee on the way home.

Caffeine Use Tips:

Keep in mind that none of this works if you are using caffeine all day just to function. Basically if you need caffeine all day, you are already fatigued and probably shouldn’t drive without a nap, an energy boost or both.

Tip One. – It takes 30 minutes to an hour for caffeine to work. This means you should have that cup of coffee or tea at least 30 minutes before you jump in the car to insure maximum alertness. The best trick is to take a 30 minute nap right after the coffee so you get the benefits of both the coffee and the nap.

Tip Two. – Since caffeine can affect sleep for up to five hours after consuming it, the rules are much the same as alcohol. No caffeine within four hours of bedtime. A good rule for nine to fivers’s is that caffeine should stop at about 4 pm to make sure you get the best sleep each night.

Tip Three. Get proper rest. Most people need six to eight hours of sleep each night and our bio rythms are designed to take a short walk and a short nap after a mid day meal.

Drive safe, we don’t want you to need our services, but if you have been in an accident and were injured, call us for a free consultation.
